Discrimination and Harassment

On my Internet journey this weekend, I came across a comprehensive site that I am adding as a permanent resource on my site. It is the Discrimination and Harassment section in the FindLaw Employee Rights Center. There you can find each protected classification described in simple language. As an employee, know when your rights are being violated; as an employer, know what not to do and learn about employee rights.

Considering Employee Layoffs?

Most employers are familiar with the WARN Act (The Worker Adjustment and Retraining Notification Act). Confusion exists in how the Act applies within individual workplaces. Basically, the Act requires employers to give employees 60 days notice before a plant closing or a mass layoff. That seems fairly straightforward, right? It’s not. As with all governmental regulations, the devil is in the detail. Jennifer Blum Feldman suggests that:

”Companies that do not give proper WARN notice often believe that they are exempt either because the company or the workforce reduction is not covered by WARN or because they believe they fall under one of WARN's exceptions.

“In some cases, companies determine for business reasons that they cannot give the required WARN notice notwithstanding the legal risk. They presume it will all get sorted out in bankruptcy if necessary.”
