The Family Medical Leave Act (FMLA) is causing much confusion in client companies. I don't know a single company that seems to administer the FMLA in the same way. Misinterpretation is frequent - and can be costly for the employer.

The key problem area I have seen revolves around which absences are FMLA-related and which absences are just absences, following the main FMLA event. The second issue employers talk about is how far does their obligation to offer FMLA time over the months following the operation, or birth or illness extend. Does an employee have to ask or does the employer have to offer FMLA time - repeatedly, every time the employee calls in, when he or she has known and used FMLA time for months?
